SFC secures first conviction against a solicitor for breaching secrecy provision

Hong Kong solicitor Mr. Tse Yin Fung, principal of O Tse & Co., was convicted at the Eastern Magistrates’ Courts for violating the secrecy provision under the Securities and Futures Ordinance (SFO). Tse pleaded guilty to disclosing confidential information related to a restriction notice issued by the Securities and Futures Commission (SFC) during its investigation into a suspected ramp-and-dump syndicate. He was fined $25,000 and ordered to pay the SFC’s investigation costs. This marks the first conviction of a practicing solicitor for breaching the SFO secrecy provision. The SFC emphasized the importance of legal professionals upholding high standards to protect the integrity of its investigations.
